| 与封闭经济相比，开放经济条件下的反垄断更复杂，更特殊，更难以处理。文章在分析外国政府反垄断政策出现的一些新的变化的基础上，指出中国由于反垄断法的缺失导致了国内市场利益和国外市场利益的双重流失，并根据开放经济条件下反垄断的特殊性和难点相应设计了中国反垄断制度的构建，即：中国应建立独立的反垄断机构；采用温和型的反垄断模式；借鉴发达国家的适用除外制度和域外适用制度来保护国民利益；注重反垄断制度与其它制度的协调。 |

| Compared with that in closed economy,the antitrust in opening economy is more complex and more special that it is more difficult to deal with.Based on the analysis of some changes about antitrust policy of foreign governments,this article points out that China has caused double losses of the interests of domestic and overseas market because of the absence of antimonopoly law,and then it designs the construction of Chinese antitrust system on the grounds of its particularity and thorny points.Concrete measures conclude: China should set up independent antitrust organization,adopt gentle type of antitrust mode,draw lessons from the exemption from application and the extraterritorial application of antitrust system of the developed countries to protect national interests,and pay attention to the coordination of antitrust system and other systems. |
