Modern intellectual property protection is the result of power discourse driven by interests. With the help of normative and practical nature, discourse shapes the creation and change of intellectual property protection system, as well as the origin and solidification of order. The international order of intellectual property protection is embedded in the power relation network with asymmetric structure, which is characterized by western center, inclination of interests and technical hierarchy, and it stipulates the hierarchical mechanism of international technical division and profit distribution. In the background of strategic competition between China and US, China should act primarily as a stakeholder in pursuit of authority, adopt neutral improvement and constructive shaping measures to support and maintain the dominant position of multilateral coordination mechanisms under the framework of WTO and WIPO, advocate the balance and cooperation of the power pattern of the international intellectual property protection order, and advocate the inclusiveness and effectiveness of international intellectual property rules，thus to promote the reallocation of discourse power and governance authority of international intellectual property rights and reasonable adjustment of interest relations with the right discourse strategy.
