Abstract:Patent infringement risk poses a significant challenge to the technological innovation of latecomer enterprises. This paper proposes a study that addresses this problem through a framework integrating Enterprise Risk Management (ERM) and Enterprise Intellectual Property Management (EIPM). The study adopts a multi-step approach that includes (1) identifying the patent infringement risk factors throughout the technological innovation process, including project initiation, research and development, procurement, production, sales and after-sales activities; (2) examining the relationship between these risk factors, leading to the construction of a related risk probability algorithm model that is factored into the overall probability assessment of spontaneous risk; (3) presenting a response map on managing patent infringement risk while considering related risks based on the determined risk level and total probability; (4) establishing a comprehensive management mechanism for patent infringement risk that involves cross-functional collaborations. This study aims to support the high-quality development of latecomer enterprises, thereby contributing to the construction of a robust intellectual property landscape.
