Abstract:Algorithmic administration plays a crucial role in enhancing efficiency and resource conservation. However, it also introduces significant risks related to the erosion of substantive rights, procedural rights, and remedial rights for individuals due to technical barriers and legal constraints. Therefore, it is imperative to establish a robust dual mechanism aimed at comprehensively safeguarding the rights of individuals affected by algorithmic administration. From a technological perspective, It is paramount to ensure the scientific validity of the data employed in algorithms, the rationality of the algorithmic models themselves, and the efficacy of the processes used for algorithmic auditing. On the legal front, it is essential to implement measures that effectively regulate information collection practices and clearly define the scope and procedures governing algorithmic decision-making processes. Additionally, optimizing mechanisms for reviewing algorithmic decisions can help protect procedural rights. To effectively protect individuals’ remedial rights within this context requires establishing an informed process for algorithms as well as enhancing disclosure measures while creating a collaborative human-machine protection mechanism. Furthermore, protecting individuals’ remedial rights necessitates establishing selection procedures for algorithms that enhance individuals’ digital capabilities and clarify liability for compensation.
