On the basis of theoretical demonstr ation of a legal system' s utility,the paper makes an overall eval-uation on the performance of China' s patent system since its foundation.The empirical analysis shows that t here is a close correlation between the numb er of patent grants and the GDP of a nation.In addition,utility models and designs have a remarkable impact on C hina' s economic development while the imp act of inventions is tiny.The author indicates that the present em phasis in the perfection of China' s patent system and other relevant policies should be placed on original technology and high technology.Meanwhile,it is also essential to better the com-mercial environment,in which paten t technology is utilized.
