The low conversion rate of patents is an important obstruct to Chinese technique innovation.The "sleeping patent" is an important reason to cause the low conversion rate of patent.This article considers that the reason of sleeping patent phenomenon is that the patent inventor and the buyer can not form a reasonable anticipation of patents value with institution restraints.The inadequacy of information,the abuse of patents in the advantage multinational company and bubbles in patent application make the patents sleeping worse.Based on this,we give some policy suggestions on solving sleeping patent problem.
